General Background
Pursuant to the requirements of the United States Patent and Trademark Office (USPTO), following final approval of trademark registration, submission of a Statement of Use is mandatory to maintain the registration status.

Policy Objective
The purpose of this policy is to ensure compliance with legal requirements and submission within the statutory timeframe to prevent the risk of registration cancellation.

Submission of Proof of Use

• Submission Deadline: The Statement of Use must be submitted within six months of receiving the USPTO's final approval for successful registration.

• What the Statement of Use Includes: Documents and examples proving actual commercial use of the trademark in the United States, such as:

  • Product labels containing the trademark.
  • Product packaging displaying the trademark.
  • Screenshots of product listings on Amazon or other websites where the product is sold.
  • Photographs and evidence of completed purchase transactions for the product.
  • Marketing materials, advertisements, or catalogs showcasing the use.
  • Website pages, receipts, or official business documents featuring the trademark.

Request for Extension of Deadline
If unable to submit the Statement of Use within the stipulated timeframe, an extension request can be filed in accordance with USPTO regulations. Clients must notify us of the need for an extension request no later than 30 days before the expiration of the statutory period.

Client Responsibility

• The client is responsible for providing all required materials for submitting the Statement of Use by the specified deadline.
• Ensuring the trademark is in actual commercial use is solely the client's responsibility.
• In cases of delay or failure to provide the materials on time, the client assumes full responsibility for any registration cancellation.

Our Responsibility

• We are committed to submitting the Statement of Use within the stipulated timelines, provided all required materials are supplied to us on time.
• We will file an extension request if requested in advance by the client and in accordance with USPTO conditions.
